Terms of Service
Welcome to Buqq. These Terms of Service ("Terms") govern your access to and use of the Buqq platform, website, vendor dashboard, booking pages, and related services.
In these Terms, "Buqq", "we", "us", and "our" refer to the operator of this platform. "Vendor", "Merchant", "Restaurant", or "Business" means a business using Buqq to receive or manage reservations. "Customer" or "Guest" means a person using Buqq to make or manage a restaurant reservation.
By accessing or using Buqq, you agree to these Terms. If you do not agree, you should not use the platform.
1. About Buqq
Buqq provides software tools that help restaurants, bars, cafes, hotels, and other hospitality businesses receive and manage customer reservations.
Buqq is a technology platform. We are not a restaurant, venue, food provider, hospitality operator, or party to the dining arrangement between a Vendor and a Customer.
Vendors remain responsible for their own venue operations, availability, customer service, food, drinks, pricing, policies, and compliance with applicable laws.
2. Who these Terms apply to
These Terms apply to:
- Vendors who create or manage a Buqq business account;
- Customers who make or manage reservations through Buqq;
- visitors who access Buqq pages, booking links, or public listings;
- anyone else who uses the platform.
Some sections apply mainly to Vendors, some apply mainly to Customers, and some apply to all users.
3. Account registration
Vendors may need to create an account to use Buqq.
You must provide accurate, current, and complete information when creating or managing an account. You are responsible for keeping your login details secure and for all activity that occurs under your account.
You must contact us promptly at info@buqq.online if you believe your account has been accessed without permission.
We may refuse, suspend, or terminate accounts where information is inaccurate, misleading, fraudulent, or where we reasonably believe the account may be used in breach of these Terms.
4. Vendor responsibilities
Vendors are responsible for:
- keeping business details, opening hours, reservation settings, table availability, booking rules, and customer-facing information accurate and up to date;
- honouring confirmed reservations where reasonably possible;
- informing Customers promptly if a reservation cannot be honoured;
- managing late arrivals, no-shows, special requests, deposits, cancellation charges, and venue-specific booking rules;
- ensuring uploaded content, including logos, images, menus, descriptions, and business details, is accurate and legally usable;
- complying with all applicable laws, including food safety, consumer protection, licensing, advertising, tax, employment, accessibility, and data protection laws;
- ensuring staff access to Buqq is appropriate and controlled;
- paying any applicable subscription fees.
Buqq is not responsible for losses, disputes, complaints, or claims arising from a Vendor's failure to manage its business, availability, service, or customer communications properly.
5. Customer responsibilities
Customers are responsible for:
- providing accurate reservation details;
- using correct contact information;
- arriving on time for reservations;
- cancelling or updating bookings where they cannot attend;
- complying with the venue's own policies;
- using the platform honestly and lawfully.
Buqq does not guarantee that a Vendor will accept, honour, modify, or cancel a reservation in a particular way. Venue policies are controlled by the Vendor.
6. Reservations
A reservation made through Buqq is an arrangement between the Customer and the Vendor.
Buqq may send booking confirmations, reminders, updates, or notifications, but the Vendor remains responsible for managing the reservation and the dining experience.
A booking confirmation does not guarantee:
- availability of a specific table;
- availability of specific menu items;
- pricing;
- suitability for allergies or dietary requirements;
- acceptance of special requests;
- service quality;
- venue opening status.
Customers should contact the Vendor directly for urgent changes, allergies, accessibility needs, late arrivals, or special requests.
7. Subscriptions and billing
Vendor access to paid Buqq features may require an active subscription.
Subscription plans, prices, billing cycles, included features, and any usage limits are shown at signup, checkout, or inside the Vendor dashboard.
Prices may be shown exclusive or inclusive of taxes depending on the checkout flow, customer location, payment provider, and applicable law. Taxes may be calculated at checkout.
Payments are processed through Polar or another payment provider that we may use from time to time. Where Polar acts as merchant of record, Polar's own payment, tax, refund, and chargeback terms may also apply.
You authorise the applicable payment provider to charge the selected payment method for subscription fees, taxes, and any applicable charges.
8. Cancellations and refunds
Subscription cancellations and refund requests are governed by our Refund & Cancellation Policy.
Unless stated otherwise in that policy or required by law, paid subscription fees are billed in advance and are not refundable.
Cancelling a subscription stops future renewal charges but does not automatically refund the current billing period.
9. Failed payments and suspension
If a subscription payment fails, we may notify the Vendor and provide a reasonable period to resolve the payment.
If payment is not resolved, we may restrict, suspend, or disable access to paid features, Vendor dashboards, public booking pages, notifications, or other platform functions.
We may restore access after payment is completed, subject to any account review or reactivation process.
10. Acceptable use
You must not:
- use Buqq for unlawful, harmful, fraudulent, abusive, or misleading purposes;
- create fake, spam, automated, or malicious bookings;
- interfere with the platform's security, availability, or performance;
- attempt to access another user's account or data without permission;
- scrape, copy, harvest, or extract data from Buqq without written permission;
- reverse engineer, decompile, or attempt to access source code;
- upload malware, harmful scripts, or malicious content;
- impersonate another person or business;
- misrepresent your relationship with Buqq;
- use Buqq in a way that damages our reputation or the experience of other users.
We may investigate misuse and may suspend or terminate access where we reasonably believe these Terms have been breached.
11. Vendor content
Vendors may upload or submit business names, descriptions, images, logos, menus, booking rules, offers, links, and other content.
Vendors retain ownership of their own content, but grant Buqq a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format, transmit, and use that content as needed to operate, promote, and improve the platform.
Vendors confirm that they have the rights and permissions needed to use and upload their content.
We may remove, edit, hide, or reject content that we reasonably believe is inaccurate, unlawful, infringing, offensive, misleading, low quality, or harmful to the platform.
12. Buqq intellectual property
The Buqq platform, software, design, branding, text, layouts, icons, trademarks, databases, workflows, and related materials are owned by Buqq or its licensors.
You may not copy, reproduce, modify, distribute, sell, lease, or create derivative works from Buqq materials unless we give written permission.
Using Buqq does not give you ownership of the platform or its underlying technology.
13. Third-party services
Buqq may rely on third-party providers for payments, hosting, email delivery, analytics, security, notifications, maps, storage, or other platform functions.
We are not responsible for third-party services outside our reasonable control. Your use of third-party services may also be subject to their own terms and privacy policies.
14. Service availability
We aim to keep Buqq reliable and available, but we do not guarantee uninterrupted, error-free, or permanent access.
The platform may be unavailable due to maintenance, updates, security issues, outages, third-party failures, internet disruptions, or circumstances outside our control.
We may modify, suspend, remove, or discontinue parts of the service where needed, including for security, legal, operational, or product reasons.
15. Data protection
Our handling of personal data is explained in our Privacy Policy.
Vendors are responsible for ensuring they have a lawful basis to collect, use, and manage Customer data through Buqq. Vendors must not use Buqq to collect unnecessary, excessive, unlawful, or sensitive personal data unless they have a valid legal basis and appropriate safeguards.
Where required, Vendors may need to enter into a separate data processing agreement with Buqq.
16. Termination
You may stop using Buqq at any time.
We may suspend or terminate your access if:
- you breach these Terms;
- payment is overdue;
- your use creates legal, security, operational, or reputational risk;
- we are required to do so by law;
- the platform or relevant feature is discontinued;
- we reasonably believe your account is being misused.
Termination does not affect rights or obligations that have already arisen, including payment obligations, confidentiality obligations, intellectual property rights, liability limits, and data retention obligations.
17. Disclaimers
Buqq is provided on an "as is" and "as available" basis.
To the extent permitted by law, we do not guarantee that:
- the platform will always be available;
- reservations will always be successfully received, displayed, or notified;
- Customers will attend reservations;
- Vendors will honour reservations;
- the platform will meet every business requirement;
- the platform will be free from bugs, delays, outages, or errors.
Nothing in these Terms affects any rights that cannot legally be excluded.
18. Liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
Subject to the above, Buqq is not liable for:
- indirect, incidental, special, consequential, or punitive losses;
- loss of profit, revenue, goodwill, business opportunity, anticipated savings, or data;
- disputes between Vendors and Customers;
- food, drink, service, safety, hygiene, pricing, venue policies, or dining experiences;
- failed, delayed, missed, duplicated, or inaccurate reservations caused by Vendor settings, user error, third-party systems, or circumstances outside our reasonable control.
For Vendors, our total aggregate liability arising out of or relating to the platform shall not exceed the amount paid by that Vendor to Buqq in the three months before the event giving rise to the claim.
For Customers who do not pay Buqq directly, our total aggregate liability shall be limited to £100, except where liability cannot legally be limited.
19. Changes to these Terms
We may update these Terms from time to time.
Where changes are material, we will take reasonable steps to notify registered Vendors, such as by email or dashboard notice.
The updated Terms will apply from the date shown above. Continued use of Buqq after that date means you accept the updated Terms.
20. Newsletter
You may subscribe to the Buqq newsletter via our website. Subscription is voluntary. You may unsubscribe at any time using the link included in any newsletter email.
21. Governing law and disputes
These Terms are governed by the laws of England and Wales, except where mandatory laws in your country of residence provide additional rights.
The courts of England and Wales shall have jurisdiction over disputes arising from these Terms, except where mandatory consumer protection laws require otherwise.
